COURIER TERMS AND CONDITIONS OF SERVICE
1. Unacceptable Courier Article
Smart deliveries cannot convey any article that falls under the prohibited items policy of the company.
Such articles include but are limited to: Animals, Cash/currency, precious stones and metals, fire arms
ammunitions, Human remains, Pornographic materials, illegal drugs and any item considered offensive
to the public according to law. High value items may be conveyed at owner’s risk after completion of a
disclaimer form available at Smart Deliveries.
2. Deliveries and Undeliverable
All articles are delivered directly to customers designated destination upon agreement with Smart
Deliveries. Smart Deliveries shall return to the consigner at a cost all items whose consignee cannot
be reasonably identified or located falling which the article may be sold to defray expenses and
remaining proceeds shall be returned to consignor.
3. Inspection
Smart Deliveries reserves the right to open and inspect any courier article in the presence of the
consigner.
4. Parcel charges
All parcels shall be charged according to destination of collection. The consigner shall pay or
reimburse all claims damages, fines and expenses incurred if the parcel is deemed unacceptable for
conveyance as stipulated in section 1.
5. Smart Deliveries Liability
Smart Deliveries liability on all articles tendered for conveyance is strictly limited to direct loss or
damage only.
All other types of loss or damage are excluded (included but not limited to lost profits, income, interest
and future business) whether such loss or damage was brought to Smart Deliveries attention before or
after acceptance of the parcel since special risks under such circumstances can be insured by the
client.
6. Payment of Claims
Smart Deliveries Shall pay or compensate a client of any loss or damage as follows:
1. If the gross weight of the courier articles 0.05 Kilograms or more MK1000 or
2. If the gross weight of the courier is less than 0.05 kilograms an amount equal to the gross weight
of the courier article in kilograms is multiplied by MK20,000.00
In the event of loss or damage to part of an article the applicable liability in 6 (i) and (ii) above shall be
reduced in the same proportion as the weight of the lost or damaged part of the article e.g. MK500.00
and MK10,000.00 i.e. half of the figure stated in 6 (i) and 6 (ii) respectively

If the client regards these limits as insufficient then they must make a special declaration of value and
request insurance as described in clause 10 courier article insurance or make their own insurance
arrangements failing which the clients assumes all risks of loss or damage.
7. Period report for insurance claims
All claims must be submitted to Smart deliveries office in writing within (30) days from the date the
parcel was tendered for conveyance otherwise the claim may not be entertained.
8. Police report for insurance claims
Smart Deliveries shall facilitate a police report for any insured lost or damaged article to enable the
client claim from its insurance company. This does not cover indirect loss or damage caused by
delays.
9. Delayed courier Article
Smart Deliveries will make a very reasonable effort to convey courier article to its regular destination
schedules within reasonable time. However Smart Deliveries may not guarantee delivery of any
articles at any specific time.
10. Courier Article Insurance
Smart Deliveries can facilitate insurance arrangements for a client’s covering the actual cash value in
respect of loss or physical damage to the article. The client is required to complete the insurance form
available at the service desk. Courier insurance does not cover indirect loss as per clause 5 or
damages and loss caused by delays.
